Goal of the “Pediatric Plastic Surgery Education” Foundation:
The main goal of this foundation is to improve education in all aspects of pediatric plastic surgery amongst craniofacial specialists all over the world. In order to do so, we annually organize two-day congresses in which we discuss specific topics of pediatric plastic surgery with the help of experts in the field. We accommodate discussions and aim to make our congresses/webinars as interactive as possible. In previous editions, the congress was performed on-site with cadaveric dissections. Cadaveric illustrations with surgical video explanations, tips & tricks from experts in the field and difficult cases will be discussed.

General terms & conditions

1. Definitions
Participant: person with whom the “Pediatric Plastic Surgery Education” Foundation comes to an agreement by supplying credentials that grants that specific person access to the webinar environment.
Name and address details: name, address, city of residence, e-mail address and telephone number of Participants.
Online webinar system: the platform in which educational content will be prepared and broadcasted.
Completed enrollment: after the Participant completed registration on our site, the registration is definitive. Refunds are only granted before xx. An administration fee of 40 euros will be withheld.

2. Applicability general terms & conditions
2.1. The “Pediatric Plastic Surgery Education” Foundation offers access for one Participant only. Access credentials are not transferable to others.
2.2 The right of use only includes the powers expressly granted in this agreement. The “Pediatric Plastic Surgery Education” Foundation is at all times entitled to provide the Participant with further (user) directions and/or other instructions regarding the use of the ONLINE webinar. The Participant declares to accept these further (user) directions and/or instructions.
2.3 The actions included in the right of use may only be performed for the benefit of the Participant’s own personal professional activities, but never in such a way that they lead or can lead to any form of commercial or non-commercial exploitation of the ONLINE webinar or any part thereof by the Participant or a third party.
2.4 The use of the ONLINE webinar system is at the expense and risk of the Participant. The “Pediatric Plastic Surgery Education” Foundation is not liable for any damage as a result of these actions performed by it on behalf of the Participant, nor for damage as a result of actions by the Participant with the ONLINE webinar.
2.5 If Participants use the ONLINE webinar system that is contrary to the directions and/or instructions of the Foundation or otherwise improper use, the Participant will be liable for all damage resulting from this use.

3. Terms of delivery
3.1 The delivery is effected by means of an agreement between the “Pediatric Plastic Surgery Education” Foundation and the Participant. Every agreement is recorded in writing.
3.2 The delivery starts after the registration has been completed on http://www.cleftpalate.nl/contact/registration.html.
3.3 After the set-up, presentations will be broadcasted with video and audio in the webinar. The on-demand version of the webinar is valid for one month. After one month it is possible to extend the on demand version of the webinar for a fee.

4. Payment and cancellation policy
4.1. The “Pediatric Plastic Surgery Education” Foundation will invoice the Participant in accordance with the payment conditions included in the Agreement. The Participant will pay the invoice within two weeks.
4.2 If the invoice has not been paid by the Participant within the term stated in the Agreement, the “Pediatric Plastic Surgery Education” Foundation is entitled to charge statutory interest on the amount due from that term.
4.3 If the Participant fails to meet his/her payment obligations after a reminder by the “Pediatric Plastic Surgery Education” Foundation, the “Pediatric Plastic Surgery Education” Foundation is entitled to have the collection by third parties take place at the expense of the Participant, or to dissolve the Agreement in whole or in part without further notice of default and judicial intervention and claim damages.
4.4 The “Pediatric Plastic Surgery Education” Foundation is entitled to suspend the fulfillment of its obligations towards the Participant, as long as the Participant has not fulfilled all its (payment) obligations. This suspension applies until the moment at which the Participant has fully complied with his/her obligations towards the “Pediatric Plastic Surgery Education” Foundation.

5. Force majeure and liability
5.1 Force majeure is defined as any shortcoming in the performance of the Agreement that cannot be attributed to the “Pediatric Plastic Surgery Education” Foundation, because it is not attributable to the Foundation’s fault, nor by law or legal act.
5.2 Force majeure explicitly includes, among other things, the improper functioning of servers, software, mains voltage, telecommunication or network facilities and the late or improper performance of work by third parties.
5.3 In the event that the Participant cannot exercise the right to use the ONLINE Webinar system as a result of force majeure, the “Pediatric Plastic Surgery Education” Foundation is not obliged to pay any compensation.
5.4 In the event of permanent force majeure, which is defined as a circumstance on which the “Pediatric Plastic Surgery Education” Foundation and the Participant have no influence or can reasonably have influence and which makes it impossible to exercise the right of use of the ONLINE webinar system, the “Pediatric Plastic Surgery Education” Foundation respectively the Participant is entitled to cancel the Agreement extrajudicially. In case of force majeure, the Participant cannot claim compensation for damage suffered from the ONLINE webinar.
5.5 Although the “Pediatric Plastic Surgery Education” Foundation strives for the utmost care with regard to the functioning of the ONLINE webinar system and the activities associated with the facilitation of a webinar, the complete absence of any errors or incompleteness in the course of a webinar cannot be vouched for.
5.6 The “Pediatric Plastic Surgery Education” Foundation is not responsible for damage as a result of incomplete or incorrect information in the ONLINE webinar system or inaccuracies or incompleteness in the facilitation of a webinar, nor for damage as a result of a webinar not being able to take place, with the exception of direct damage as a result of errors caused by intent or gross negligence on the part of the “Pediatric Plastic Surgery Education” Foundation.
5.7 Use of the ONLINE webinar system at the location of the Participant is at the risk of the Participant. If equipment, software, network or internet connection prove to be inadequate, the “Pediatric Plastic Surgery Education” Foundation will not be liable for any damage, and will not be obliged to facilitate a webinar again free of charge.

6. Intellectual Property Law
6.1 All royalties and other potential rights of intellectual property are exclusively owned by the “Pediatric Plastic Surgery Education” Foundation.
6.2. No provision in the agreement extends to the full or partial transfer of rights to the Participant as referred to under 6.1.

7. Description of acts and powers
7.1 The Participant will gain access to the ONLINE webinar system electronically, via the internet. The Participant gains access to the system through the Customer’s administrator. Only the administrator is authorized to perform actions within the ONLINE webinar system. The administrator is appointed by the organizing committee.
7.2 The name and address details will be saved and will only be used by the “Pediatric Plastic Surgery Education” Foundation for the purpose of inviting potential Participants to a future webinar/congress on behalf of the “Pediatric Plastic Surgery Education” Foundation
7.3 The confirmation process consists of no more than two e-mail messages to one and the same potential Participant in a webinar, namely a confirmation and a reminder. This is possibly supplemented with a text message as a reminder if the mobile number of the potential Participant is known to the host of the webinar.
7.4 The presentation is given by an employee of the “Pediatric Plastic Surgery Education” Foundation, possibly with the help of moderators.
7.5 The “Pediatric Plastic Surgery Education” Foundation reserves the right to analyze data resulting from a presentation, exclusively for the purpose of optimizing the ONLINE webinar system.
